Ecigarettes on Hold?

ecigarSales of e-cigs have been on the rise in the United Kingdom, United States, Switzerland, Sweden and Brazil for several years. The trend prompted the World Health Organization to issue a statement in 2008 calling for more safety testing.. “If the marketers of the electronic cigarette want to help smokers quit, then they need to conduct clinical studies and toxicity analyses,” the statement said.

Then I received the following letter !

RE: NJOY Electronic Cigarettes

Dear Valued NJOY Customer,

First, we certainly appreciate your patronage and enthusiasm over the NJOY family of products. We have all been quite pleased with your overwhelming response to this product and recognize you as a very valued customer.

Unfortunately, we must apologize for our current inventory shortages which have resulted in extended delays in your continued purchases of NJOY products. We have recently experienced an interruption in our supply of NJOY Electronic Cigarettes, cartridges and related accessories as a result of the FDA claiming jurisdiction over the product. FDA has detained most shipments of electronic cigarettes and related accessories entering the U.S. for the past several weeks. Their assertion is that nicotine is a drug and the electronic cigarette is a device whose intended use is to deliver that drug. We do not agree with the position or actions of the FDA.

250px-components_of_a_miniciggy_e-cigaretteTo defend our position of continuing to bring customer like you the first true innovation in a centuries old space, NJOY has enlisted a team of attorneys, scientists, lobbyists, and other experts whose belief is that the FDA has over stepped the bounds of their authority in this detainment action. We encourage your help to ensure the survival of the e-cigarette as an alternative to traditional tobacco cigarettes that continue to kill 400,000 Americans each and every year.

Below is a list of some things you can do to help the cause.

1) Write your Senators and other elected officials. Tell them about your experience with the electronic cigarette. Send it certified mail. Sample text: “I am a loyal customer of the smoking alternative NJOY, and I have been informed that the FDA has taken the step to bar importation of more products at this time. I want you, as my elected representative/senator in Congress to help me continue to enjoy this product by asking the FDA to remove their detainment order from Customs.”

Write President Obama

2) Contact your local newspaper or other media, Tobacco Free Kids, American Lung Association, American Cancer Society and other public health organizations to inform them about your experience with the electronic cigarette.

At this moment, we do not know when shipments are expected to resume. We have supplies of certain replacement cartridges currently available for immediate delivery but those supplies are being rapidly depleted. Once this situation is resolved to our satisfaction, we will enthusiastically support your continued use and support of all the NJOY products and accessories.

We will continue to keep you informed as things develop.

Mackinaw, LLC
Proud U.S. Distributor for NJOY .

Now here is the debate. Should the FDA be involved with this product? The FDA is also involved in other nicotine delivery products such as Nicrorette.

Should the FDA just let the product come in and give the ecigarettes companies a date to which they must adhere to the standards?

I would be interested in what your opinion would be.

  6. Owen Says:

There is the addiction to nicotine but also the “smoking experience” (mini break, chatting with other smokers) – both can be fulfilled by the electronic cigarette without tobacco and tar. And on top of that you can use low or zero nicotine cartridges. Not a bad option … Oh, and no lingering smoke odor.

  7. Linda Says:

Hi Qi … Okay! Sounds good.

  8. Linda Says:

Hi Diane … LOL! you will certainly learn about them by doing that! 🙂

  18. Cosmos Says:

So, there is another way of smoking! Though it is free of smoke and the dangers of passive smoking, it has yet the harmful effects of over-smoking with this e-cigarette.

  24. Electronic Cigarette Guy Says:

Although the FDA is currently in on-hold mode, we do expect to hear from them by the end of the year. At the ECA, we are trying to calculate exactly what their next play will be, however we are hopeful that it wont be a complete ban of electronic cigarettes. If his is the case, they will be forced underground, which has proven to be more detrimental in the long run. It will be an interesting few months…

  25. Linda Says:

Hi Johnny … It sure will be interesting. Are they (FDA) letting shipments in?

  26. E Cig Smoker Says:

What we need is to get the public educated on the existence of the e cigarette. When more people start to use them and realize how helpful they are they are less likely to get banned.

Unfortunately at the moment there is only a small core of smokers using them and we don’t have a big enough voice to make a difference. We are never going to be heard when we are up against the might of the pharmaceutical industry.
